Know all men by these presents that we Willie Bell and his wife Ovia Bell have this day bargained and sold and do hereby transfer and convey unto J. R. & M. C. Wade their heires and assigns the following described land on the Big Branch in Jackson County Tenn., the place we now live on and purchased of late Kirby and wife. Beginning on a Walnut makred by B. Byrne and James Maberry as a conditional corner about half way up the hill on west side of Big Branch near John Hargises line thence with said line to James Guesser line thence with said line to Issiac Willabys original ine thence with said line to Thankston Carters line thence with Carters line to James Hargises line thence with said line to the top of the Rock House Ridge to a conditional corner between B. Byrne & James Maberry now U. T. Spurlock thence with Spurlock line to the beginning containing fifty acres more or less for the consideration of six hundred and fifty dollars paid as follows; one note executed by J. R. & M. C. Wade to R. V. Brooks for four hundred & sixty dollars with interest from the 23 Jan 1904 which is to be paid one third 23 Jan 1905 & one third to be paid Jane 23 1906 & the other and last third to be paid Jan 23 1907 & one note being held by Sam Carver for one hundred and eighty two dollars. Which notes is for purchase money lien and to be paid now we Willie Bell and his wife Ovia Bell covenant with J. R. & M. C. Wade that we are lawfully seized of said land & that the same is unincumbered only as above set out and that e will forever warrant and defend the title of said land unto J. R. & M. C Wade their heirs & assigns from us & our heirs and all persons whatever given under our hands this July 18, 1903.

We Almer Willoughby and Richard Willoughby hereby transfer and convey to M. C. Wade his heirs and assigns forever and hereby quit claim to our one half interest in a tract of land herein after described it being one half of the right hand side of the hallow which fell to M. C. Wade in a divide made by us in a tract of land more fully described in an original deed and joint deed we hold beginning on a Locus at the mouth of the hallow in U. T. Spurlocks heirs line thence with an agreed line made by us up the branch with meanders to a hickory bush at the mouth of the second hallow thence up the right hand hallow to a stake in James Guesser (sic) line said land being in the State of Tenn 5 Civil District of Jackson County and the place on which M. C. Wade now lives to have and to hold said one half undivided interest to M. C. Wade his heirs and assigns forever we covenant that we are lawfully seized of said land and have a good right to convey the same and we hereby quit claim to our one half interest in said land and bind ourselves our heirs to forever warrant and defend this title to Mack Wade his heirs and assigns forever against the lawful claims of all persons claiming under us whomsoever in witness where of we hereunto subscribe our names this December 29, 1910.

Now we Mac Wade, Hanna R Wade, Victoria Wade being son and daughters of L. C. Wade Decd and Willie Wade a grand son of the said L. C. Wade have sold and do hereby transfer and convey in trust to Chas Brown trustee our ____ undivided interest which is seven-eigths of the lands of our father L. C. Wade lying on the waters of Big Branch in the 5th District of Jackson County Tennessee containing 65 acres more or less and for a full description of these lands refference is made to the records in Gainesboro its the old home place of our father. Now if this note is paid in full on or before due then this obligation to become void and for nothing held otherwise to be and remain in full force and effect and if default of payment of the note after due the trustee herein ____ or his successors will advertise the land for sale as the law directs in such cases for cash and will proceed to sell the land after proper advertising such sale and will with the proceeds from the sale first pay off all cost in selling as well as any attorney fees if needed next pay the note herein secured with any interest due and last pay remainder if any to us or our order, to have and to hold we covenant with the trustee that we lawfully seized and possessed with such land have a good and perfect right to convey the same that it is unincumbered and that we warrant the title to said trustee or his assigns against the lawful claims of all persons whomsoever this January 5th 1925.

For the purpose of securing A. J. Harley in a note this day executed to him for the sum of $127.50 we this day sell to said Harley the following property to wit; all that is left of one half interest in a saw mill engine ___. It being the saw mill that W. J. Woodbright and A. J. Harley bought on Jim Shoemake, also the following described property to wit. One horse mule three year old, also one bay mare about 6 years old, the property of L. C. Wade also black horse owned by N. H. Buroughs, also one sorel mare owned by Buroughs the above mentioned note is due and payable on the first day of August 1906 and bears interest from date. Now if the said note is paid off on or before the 1st day of Aug. 1906 this is to be void, otherwise we authorize the said Harley to sell said property either publicly or privately as he thinks best and apply the proceeds of same to payment of the above note and balance if any, pay to us. This is in lieu of Bill of Sales executed to said Harley for the above property on this 28th day of Feby 1906. We waive all notices in sale of said property and agree to pay cost of this conveyance and expense of sale out of the proceeds. This March 5, 1906.

Note Marion Farris and Letha Wade were married October 3, 1863 in Granville, Jackson County, TN. They moved to Kentucky about 1867. In 1867 or 1868, Marion purchased a parcel of land from Nathaniel Moxley near Trisler, Ohio County, Kentucky. Due to Marion's disability could not work land and gave back to Nathaniel Moxley. His Pension Application was filed on October 7, 1881. Marion and Letha later moved to North Little Rock, Arkansas. Letha filed a Widow's Application on April 12, 1920.

In the original application, Marion and Letha Farris were living in Spring Lick, Grayson County, Kentucky, March 12, 1884. The disabilities claimed are deafness in one ear and rheumatism, contracted in fall of 1864. The rheumatism was contracted while scouting near Liberty, DeKalb County, Tennessee and the deafness was contracted near Murphreesboro, Tennessee. "A cannon ball passed so close to me that I fell down on my hands and knees. I have noticed the deafness ever since."

During the initial deposition Marion Farris was asked if he served in the Confederate Army. His response was "No", but he told the investigator that he, along with about five others was arrested by the Confederacy. He added that he managed to escape.

Thus the process began trying to determine if Marion Farris acquired his disability while serving in the Army and whether he served in the Confederate Army.

The complete file on Marion Farris and Letha Wade Farris (Widow's Application for Pension No. 1155880) is 236 pages. On Marion there are 111 documents containing applications, depositions by friends and relatives. Comrades from the Union and the Confederacy submitted affidavits. Regarding his disability there are claims Marion had rheumatism prior to service, however a greater number of affidavits claimed he did not complain prior to service. There were several who said they knew him while serving in the Rebel army in a guerilla company. There were many more affidavits that claim he was very loyal to the Union. An interesting fact is that Marion had two brothers that did serve in the Confederacy. There was a document provided about his military service that indicated Marion Farris did serve in the Confederate Army for two month.

In a depostion dated December 23, 1898, Marion Farris stated, "Our family name was variously spelled, sometimes Faris, Pharis, Pharris and Fariss, but the correct spelling is Farris." Marion's father was Isom and in the 1850 Census the last name was spelled Pharis.

James K. Farris, half brother to Marion, was 64 years of age on a General Affidavit and lived in Christopher, Franklin County, Illinois on December 24, 1920. He was testifying to the marriage of Letha Wade and Marion Farris on a Widow's Application No. 1155880.
