I, John Gwinn of the County of Person and State of North Carolina being weak in body but of sound mind and memory, do make this my last Will and Testament in manner and form following. Inprimis. To my well beloved wife Jane Gwinn, I will and bequeath the following negro slaves; Old Will, Jim, Sias, Dick, Anderson, Phill, Bobb, Ben, Little Will, John, Hanah, Mender, Anne, Mary, Willey, Jude, Rachel, Amy, Malissa and Ellen. The tract of land on which I live containing three hundred and sixty one acres and a half, more or less, my stock of horses and cattle consisting of work steers, cows and calves, all my stock of hogs, and sheep with all my household, and kitchen furniture and my plantation tools of every description, my waggon and riding chair, and harness to her and her heirs forever. Item: I will and bequeath to my half sister's son, Robert Jones, two young negros viz; Burrel and Peggy to him and his heirs forever. Item: I will and bequeath the following negros; Rhoda, Buck, Ben, Russell, Burrell, Hanah and their increase to John G. Wade, Edmund Wade, Tinsley Wade, Jane Wade, Polly Wade, Sally Wade, Robert Wade and James Wade, children of Robert Wade and Ann, his wife to be equally divided amongst them when James Wade arrives at the age of twenty-one years. The above named negros are my property, tho in the possession of Robert and Ann Wade, and such is the disposition I chose to make of them and I request my friend James Williamson to act as Trustee of the above named negros for the use of Robert and Ann Wade's above named children. Item: It is my will that all my just debts be paid by my beloved wife Jane Gwinn. It is my will and desire that my very good friends Samuel Pointer and James Williamson be executors of this my last Will and Testament. In testimony of this being my last Will and Testament, I have here unto set my hand and affixed my seal this 10th of April, 1816 in the presence of Elizabeth H. Woody and Currie Barnett. My Grandfather Hunt (Memucan) had a brother, Nathaniel, who went into the Army, was gone seven years, and his wife, supposing him to be dead, married again. He came back, and calimed his wife, but she preferred the second husband. He then went to Lincoln County, Tennessee and married again, and had children, some of whom moved to Shelby County, Tennessee and to DeSoto County, Mississippi. This Nathaniel Hunt, when old and poor, hired a man to go on foot with him to his nearest relatives, in Granville County, North Carolina. He was to give him his horse and equipage for so doing. The first relative's house he reached was my father's where the footman took possession of the old man's horse, and returned to Tennessee. The old man finally took up at Colonel William Hunt's, as he had plenty of room and property, and there I saw him in 1825. His first wife was still living, a widow, and had considerable property. David Graves, a wild, reckless man, who married my mother's sister, Nancy, persuaded the old man to call on his first wife and propose a second marriage, but she informed him that she had had enough of him when he was younger. He abandoned the matter, and soon afterward, died at Colonel Hunt's.
Lunenburg County, Virginia, August Court, 1763 Nathaniel Hunt & Elizabeth, his wife. Plaintiffs vs Andrew Wade, Defendant. On a motion to prove the verbal gift of a Negro slave named Lucy, said to be made by the Defendant to the Plaintiff Elizabeth, before marriage. The Defendant being in Court and acknowledging to have received legal notice of this mother, the following depositions were taken: Memucan Hunt of lawful age, deposes that for about 5 years, said Nathaniel Hunt has as the Defendant believes, been absent from this Colony and that he believes said Nathaniel Hunt did never return to this Colony until about last November from which testimony and many other circumstances, the Court is satisfied and does adjudge that said Nathaniel has been , for said time, absent as aforesaid. Page 198 John Boiling of lawful age deposes that some years ago and before the said Nathaniel's marriage with the said Elizabeth, he, the deponent, was at the house of Andrew Wade Sr. and that a discourse arose about the said Wade mentioning a small Negro girl called little Lucy, said that Negro is not mine. I have given that to my daughter, Betty, and that he, Wade, did not claim it as any part of his estate. The deponent further says that the said Wade further told him that was not all he intended to give his said daughter for that if she married a man he like, he would give her 100 pounds more. William Drew of lawful age, says that sometime before Nathaniel Hunt and Elizabeth, the daughter of Andrew Wade were married, he, the deponent, was in company with said Andrew Wade, said Nathaniel Hunt being then present and the said Wade declared he intended to give his daughter, Elizabeth 100 pounds and a likely young Negro, in case his said daughter should marry with his approbation. William Roberts of lawful age, says sometime after Nathaniel Hunt's marriage with Elizabeth, the daughter of Andrew Wade Sr., he understood there was a suit commenced in Lunenburg Court by the said Hunt against the said Wade on a promise made him in consequence of his marriage with the said Elizabeth, that he was informed the said Hunt had recovered a judgment agains the said Wade. Wade and Hunt tried to reach a compromise. Wade gave Hunt 50 pounds which Wade said he was giving Hunt in part ofhis daughter's fortune. Hunt agreed to not pursue the suit further. Page 199 Benjamin Abbot of lawful age, deposes that he was in company with Andrew Wade Sr. and Nathaniel Hunt, and they were about making up the suit the said Hunt had brought against the said Wade in right of Elizabeth, his wife, that Wade proposed that if Hunt would drop his suit and trust to Wade's honor, he would use him well, but would not be obliged to give him anything more than he pleased, and that Wade would pay his ouwn costs of the suit to which Hunt agreed. Whereupon Wade immediately gave him 50 pounds and promised further to consider him and that Hunt should have no cause to complain of him, from which the deponent understood that Wade intended to make Hunt some further satisfaction. Memucan Hunt, deposes that he heard Andrew Wade say that if Nathaniel Hunt would not further proceed on his suit, he should be no loser, that he would fill both his hands with money. Sometime after Wade gave Hunt the 50 pounds this deponent heard Hunt demand a further sum of Wade and Wade refused to pay it at that time, but Hunt threatening a suit, Wade made some promise of a future satisfaction. It is the Court's opinion, after considering the aforesaid depositions, that the testimony is sufficient to establish the gift of said slave Lucy to the Plaintiff Elizabeth. Memorandum that at the time of taking the foregoing depositions, the Defendant suggested that the Plaintiffs had employed Paul Carrington & clement Read, Gent, the only practicing attorneys at the bar, and moved the Court to assign him one of them, whereupon the Court assigned to the Defendant, said Paul Carrington, but he refused to be concerned for the Defendant alleging for reasons that he had received the secrets of the Plaintiff's cause and that the Defendant would pay him no fee.1 |
