SELF-DEFENSE CLAIMED

Thomas Willet Shot and Killed at Red Lodge by Charles Sweeney

Two Bulletts Sent Into Willett's Body, One Near the Heart and One in theAbdomen

Red Lodge, May 16, about 9:30 o'clock last night, Charles Sweeney shotand killed Thomas Willett in this camp, and afterwards surrenderedhimself to Constable John Stem, asserting that the killing was done inself defense. The shooting occurred near the saloon of Wm. Larkin, whereWillett was carried dying in a few minutes without speaking. He was shottwice, once in the left breast, near the heart and once in the abdomen.Keyser Brown, justice of the peace, acting coroner, impanneled a jury,and an inquest will be held tomorrow, The shooting occurred in thepresence of four or five witnesses. It i said that Willett had a knifein his hand and was crowding Sweeney when the later opened fire.Willett's knife was found on the ground by his side. Both men areminers, Sweeney holding an elective office by the miners, being checkweighman. He has always borne a good reputation, was quiet, sober andindustrious, and regarded as a good citizen. He has a wife and onechild. Willett leaves a wife and six male children in destitutecircumstances. He was a hard drinker, but not regarded as a vicious or abad man, although he has been known to threaten parties with his knifewhen under the influence of liquer.
It is said he was drinking pretty heavily yesterday and Sweeney and hehad some words. There had been no bad feeling between the two men so faras known.

Red Lodge, Mont., May 17,1892- In the Sweeney-Willett shooting case,Coroner Moon of Big Timber arrived today. He examined the body of thedeceased man and decided that an inquest was not necessary. Theprelinimary examination began at 8 o'clock this evening beforeKeysor-Brown, justice of peace, at Blackburn's hall. Acting CountyAttorney Miller of Livingston is conducting the case for the state, andJohn T. Smith of Livingston, W.F. Meyer and A.P. McAnelly of Red Lodgeappear for the defense. One witness was examined this evening, whencourt adjourned until 9 o'clock tomorrow morning. The defense admit thekilling and claim it was done in self defense. The interest in the caseis intense and the hall was packed with spectators.

Thomas Willett and his family lived near New Haven, Ky. Thomas spent his life farming. He wrote his will October 08, 1838 and it was probated in Nelson Co.,Ky. on January 14, 1839. In his will (2:434) Thomas Willett mentioned his wife Elizabeth, his sons, Thomas B. Willett, Richard B.Willett, Robert A. Willett, George E. Willett and John R. Willett, his son-in-law Thomas Green, Dau Mary Willett and his sister Mary Ann Willett who was to 'have the priviledge of her house and small garden, firewood,etc., during her life.' He named his son Richard B. Willett and Michael Spalding 'my dearly- beloved friend,' as his executors.

On August 3, 1841, Richard Head was appointed as guardian of Robert A., John R., and Edward G. 'infant heirs of Thomas Willett, desc'd' (GuardianSettlement 1:91-92). In guardian accounts any children who were not of age were referred to as infants.

Michael Spalding received land 'which descended to the heirs of Thomas Willett.' Michael Spalding allotted this land to Thomas Green and his wife. The land was conveyed by Green and his wife back to Michael Spalding. On August 28, 1857 Michael Spalding sold this land, which was situated on the banks of Pottenger's Creek, to Peter and Jeremiah Brown.(Deed 30:361).

Elizabeth Willett, the widow of Thomas Willett, marr'd. 2nd. FrancisPeak. She was still living in 1867 when Thomas B. Willett and his wife Elizabeth sold the land to George W. Masterson. The land had been owned' by Thomas Willett desc'd and allotted to Elizabeth Willett, wife of Thomas desc'd and being occupied by Francis Peak and his wife who was formerly the widow of Thomas Willett---(Deed 36:208).
