Second: While entertaining for my son-Dr William Shackelford, the warmestpaternal regard and affection, but in consideration that in hisacademical and professional education and outfit in life, I have expendedmore than upon any other children, and as I conceive, sufficient for hissuccess in life, it is my will that he receive no further portion of theestate of which I may die possessed of, excepting that as furthertestimony of my affectionate esteem, I devise to him my gold headed cane. Third: To my youngest daughter--Lou Ann, I will and bequeath the bed andbedding, the bureau, the wardrobe and wash stand, which was her mother's,and one thousand dollars in money. Fourth: It is my will hereby expressed, that the remainder of the estateof which I may die possessed, shall be equally divided, after the paymentof the necessary incidental expenses of administration, among my fivechildren--Priscilla Wingate, Mary Owens, Elizabeth Larew, James J.Shackelford and my aforesaid daughter--Lou Ann. It being my will that myyoungest daughter--Lou Ann, in consideration of her minority, shall havethe aforesaid special devises which I have heretofore made to her, ofpersonal household property and money, in addition to the equaldistributive share of the balance of my estate. Fifth: The devise which I have made to my four daughters is hereby madeto them and their children, to be held by them to their separate use,separate and apart from their husbands, or any husbands they mayhereafter marry. And in the event that either of them should die withoutleaving any children, it is my will, and the foregoing is made on suchexpress reservation, that the portion of my estate devised to her asaforesaid, shall revert to her surviving sisters and their children, andmy said son--James Shackelford, in equal portions, such distributiveshare so reverting, to be held to the like separate use of my survivingdaughters as aforesaid, and their children. And if the sale of my real estate shall be necessary for equaldistribution among my five children aforesaid, or any portion thereof, Ihereby empower my executors hereinafter named, to sell and convey thesame, but the proceeds of said sale must remain in the hands of myexecutors in trust, for the use of her children, until re-invested inother real estate at the option of my daughters, the conveyance or titleof such estate to be made to my said daughter or daughters and theirchildren, separate from any title or claims of their husbands or power tosell or encumber the same by their husbands. Any portion of my personal estate chosen in action or money, which underthe provisions of the foregoing will, shall be distributable to mydaughters, or either of them, as also the additional one thousand dollarsdevised to my youngest daughter--Lou Ann, shall be held by my saidexecutors in like trust as aforesaid, until in like manner invested inreal estate as aforesaid. Lastly: I appoint my son James J. Shackelford, and my nephew--James A.Johnson, executors of this my last Will and Testament, hereby vestingthem or either of them who may qualify, with all the power hereinprovided, as fully as though both had qualified as such. All of 'Tidewater' Virginia is full of Shackelfords, even to this day,and they must be descendants of the immigrant, Roger. In the petition Ann andElizabeth mentioned as widows in 1734. After their arrival in Spottsylvania the Family Fortunes must haveimproved vastly, as the County records show many land transactions,purchases, sales, with records of slaves - et cetera. 'Ann Freeman and Elizabeth Shackelford, and the heirs of the body of thesaid Christopher Robbins, forever; and that all and every person orpersons whatsoever, who by the last Will and Testament of the said JohnRobbins, might have claimed the said first mentioned intailed lands nowvested in the said Henry Willis, by virtue of the limitations of the saidJohn Robbins' last Will and Testament shall forever hereafter, hold andenjoy all and singular the said last mentioned lands and premises, withthe appurtenances, successively, one after another, as they might haveclaimed and held the same intailed lands, if that or this act had neverbeen made. All of 'Tidewater' Virginia is full of Shackelfords, even to this day,and they must be descendants of the immigrant, Roger. Their petition was aprovedand they moved in a body with their children and grand children to StGeorge's Parish Spottsylvania County, in 1736. In the petition Ann andElizabeth mentioned as widows in 1734. After their arrival in Spottsylvania the Family Fortunes must haveimproved vastly, as the County records show many land transactions,purchases, sales, with records of slaves - et cetera. 'Ann Freeman and Elizabeth Shackelford, and the heirs of the body of thesaid Christopher Robbins, forever; and that all and every person orpersons whatsoever, who by the last Will and Testament of the said JohnRobbins, might have claimed the said first mentioned intailed lands nowvested in the said Henry Willis, by virtue of the limitations of the saidJohn Robbins' last Will and Testament shall forever hereafter, hold andenjoy all and singular the said last mentioned lands and premises, withthe appurtenances, successively, one after another, as they might haveclaimed and held the same intailed lands, if that or this act had neverbeen made. ' James and Elizabeth Robbins-Shackelford, are the ancestors of many of thepeople of the name that later settled in Culpepper, Fauquier, Orange andAlbemarle Counties, Virginia. Note-Shackelford | Roger Shackelford The first reference we have ever found of Roger among the Virginia landrecords, is a grant of land to Roger himself, recorded in Land Book VI,page 665, and dated November 20th, 1678. But by this record itself, it isshown that Roger already had one plantation. The name of Roger is last found on the Quit Rent Rolls, of King & QueenCounty, in 1704. He was a member of the Vestry of Petsworth Parish in1679. He was Church Warden in 1680 to 1683. This Roger wassupposed to have fled England to save his head. He is likely the sameRoger baptized April 23, 1629. He would have been about 20 in 1649, thedate given by Minor Gibson as the date of entry into the colonies. Hearrived in VA on 6/4/1658. (ref: Vol II, Echoes of The Past) Submitted by: Bill Shackelford 1997 Chart #2 http://members.tripod.com/~wvgal/sdes2.htm ------------------------------------------ ROGER, THE IMMIGRANT It is generally conceded by those who have been interested in studyingthe history and genealogy of the Shackelford family in Virginia that theimmigrant was named Roger. One writer has stated that the immigrant wasJohn, but it is my belief that John was a son of Roger. The abovereferred to writer states that John was living in King and Queen Countyin 1649. I have not been able to substantiate this. King and Queen wasnot formed from New Kent until 1691. It is known, however, from the records that Edward Palmer, from England,received a patent or grant of 400 acres in Gloucester for thetransportation of eight persons, including Roger Shackelford. The date ofthis grant was June 4, 1658. The actual arrival of those transported musthave been a year or more before this date. Edward Palmer had a sister, Mary, on this list and there is good reasonto believe Roger Shackelford married Mary Palmer. The following land grant (Land Book VI, p. 665) to Roger appears underdate of Nov. 20, 1678, during the Governorship of Sir Herbert Jeffries.'Roger Shackelford-313 acres of land in Gloucester County, Virginia,beginning to be measured at a corner chestnut tree standing nearMataponyold path and touching the land of Edward Parker (or Palmer?), Mr.Patridge, by the branch on the back side of the said Roger Shackelford'snow plantation. The land being due the said Roger Shackelford by twoseveral purchases and by virtue of a deed of sale from Mr. SamuelPatridge and Thomas Hawks (?) who are now both deceased and now plainlymarked with lines and corner trees according to the above mentionedbounds'. (Note: - By the wording of the above it is seen that Rogeralready had one plantation.) In Virginia Quit Rent Rolls taken 1704, 'a true account of the lands inKing and Queen County, Virginia, as it was taken by Robert Bird, Sheriff,we find the name Roger Shackelford, 250 acres'. Roger Shackelford appears as a member of the vestry of Petsworth Parish,Sept. 13, 1679. On October 14, 1680, Roger was appointed Church Warden,in same Parish for the 'ensueing year' for upper part of Parish. Roger was present as a Warden at a Vestry Meeting, Oct. 24, 1682 andagain Sept. 24, 1683. At that time in Virginia's history Vestrymen andWardens and those elected 'to procession', were chosen only from the mostsubstantial citizens. I do not know the exact location in either Gloucester or King and Queencounties where Roger and Mary Palmer, his wife, lived. Search has beenmade to find Roger's will, but without success. The date of his death andplace of burial are also lost to any records I can find, but he must havedied after 1704, as he appears on the Quit Rent Roll for that year.
